Kymara Health Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Kymara Health website at https://kymarahealth.com and related tools and services (collectively, the “Services”). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Who we are
Kymara Health (“Kymara”, “we”, “us”, or “our”) is a digital health product that provides cycle tracking, calculators, educational content, and related tools. We are not a medical practice and do not provide medical diagnosis, treatment, or prescriptions.
2. Eligibility and account
To use the Services, you must:
- Be at least 16 years old (or the minimum age in your jurisdiction to consent to digital services).
- Have the legal capacity to enter into a binding agreement.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us promptly of any unauthorized access or suspected security breach.
3. Health disclaimer (no medical advice)
Kymara is intended for education, self‑tracking, and personal insight only. It does not provide medical advice and is not a substitute for consultation with a qualified healthcare professional.
You understand and agree that:
- Any content, tools, results, or suggestions provided by Kymara are for informational purposes only.
- Kymara does not diagnose, treat, cure, or prevent any disease or condition.
- You should not disregard medical advice or delay seeking medical care because of anything you read in the app.
Always seek the advice of your doctor or other qualified health provider with any questions you may have regarding a medical condition, fertility, contraception, pregnancy, or medications.
4. Subscriptions, billing, and cancellation
4.1 Plans and billing
Kymara offers free and paid subscription plans. Details of our current plans and pricing are displayed in the app and may change from time to time.
- Paid plans renew automatically at the end of each billing period (monthly or yearly) until canceled.
- Payments are processed by Dodo Payments, which acts as merchant of record and charges your selected payment method on our behalf. We do not store your full card details.
By starting a paid plan, you authorize Dodo Payments to charge the subscription fee to your chosen payment method according to the billing cycle you select.
4.2 Managing your subscription
You can manage your subscription (update payment method, switch plans, or cancel) through the billing portal linked from within the app. Upon cancellation:
- Your access to paid features continues until the end of the current billing period.
- After that, your subscription will not renew and you will revert to the free plan.
Fees already paid are generally non‑refundable except where required by law or where we explicitly state otherwise.
4.3 Free trials and promotions
We may offer free trials or promotional discounts from time to time. Additional terms may apply; if so, they will be presented at the time of the offer.
5. Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, or abusive purpose.
- Attempt to interfere with or disrupt the integrity or security of the Services.
- Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
- Access or use the Services to create a competing product or for benchmarking not authorized by us.
- Upload or share content that is illegal, abusive, defamatory, or infringes the rights of others.
We reserve the right to suspend or terminate your access to the Services if you violate these Terms.
6. Intellectual property
The Services, including all software, content, designs, logos, and trademarks (excluding your own content and data), are owned by or licensed to Kymara and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for your personal, non‑commercial use.
You may not use our trademarks or branding without our prior written permission.
7. Your content and data
You retain ownership of the personal information and health data you enter into Kymara.
By using the Services, you grant us a limited license to use, store, process, and analyze that data as necessary to:
- Operate and improve the Services.
- Provide insights, tools, and features to you.
- Fulfill our legal obligations.
We may also use aggregated and de‑identified data for analytics, research, or to improve the product, provided that such data cannot reasonably be used to identify you.

8. Third‑party services
Kymara integrates with third‑party services such as Supabase, Dodo Payments, PostHog, Resend, and hosting providers like Vercel.
These services are subject to their own terms and privacy policies. We are not responsible for their content, policies, or practices, but we work to choose reputable providers that align with our privacy and security standards.
9. Availability and changes to the Services
We strive to keep the Services available and reliable, but we do not guarantee uninterrupted or error‑free operation.
We may modify, suspend, or discontinue parts of the Services at any time, including adding or removing features, changing pricing, or updating plans. When changes significantly affect existing users, we will aim to provide reasonable notice, for example by email or in‑app notifications.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.
Without limiting the foregoing, we do not warrant that:
- The Services will be uninterrupted, error‑free, or secure.
- The tools, predictions, or insights provided by Kymara will be accurate, complete, or suitable for your specific circumstances.
- The Services will meet your expectations or health goals.
Any reliance you place on information obtained from the Services is at your own risk.
11. Limitation of liability
To the fullest extent permitted by law:
- Kymara and its owners, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services.
- Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid us for the Services in the 3 months preceding the event giving rise to the claim (or, if you use the free plan, USD $0).
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Kymara and its owners and affiliates from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
- Your use of the Services;
- Your violation of these Terms; or
- Your violation of any rights of another person or organization.
13. Termination
You may stop using the Services at any time and may request account deletion via the app or by contacting us.
We may suspend or terminate your access to the Services if:
- You violate these Terms;
- We believe your use poses a security or legal risk; or
- We discontinue the Services.
Sections that by their nature should survive termination (such as intellectual property, limitations of liability, and dispute provisions) will continue to apply.
14. Governing law
These Terms are governed by the laws of South Africa, without regard to its conflict of law principles. Any disputes arising out of or relating to the Services or these Terms will be subject to the exclusive jurisdiction of the courts located in South Africa, unless applicable law requires otherwise.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top and, where appropriate, notify you via email or in‑app.
If you continue to use the Services after new Terms become effective, you agree to the updated Terms.
